(Regarding complaints related safeguards)
There is a provision under Section-9 (1) of Commission Act that investigation of particular complaints regarding the denial of rights and safeguards of the backward class.
Arrangements are made for this work in Rule-10 of “Commission Process Regulation 1999.”
- On receiving the complaint, Chairman may allot it to some deputy chairman/member. If it is found that doing inspection/hearing by such members is appropriate and needed, then for this, necessary proceedings will be done according to Khand (B) and (C). After receiving the report if concerned Hon’ble Deputy Chairman/Hon’ble Member (from whom decision has been taken to bring the report in case) decision-making/filing office is decided without trial then information of case submission will be sent to concerned parties after receiving the approval on decision taken by Hon’ble Deputy Chairman/Hon’ble Member and if it seems to be no requirement of doing inspection over prima facie investigation of complaint then such matters will be considered in the meeting of commission. After its consideration, if complaint is not found eligible for above proceedings then such complaint will be circulated, whose information will be sent to the complainant. If decision of investigation/hearing is taken regarding that complaint in meeting, then accordingly hearing will be conducted as per provisioned in section (B) (C) and (D).
- Regarding complaint for which decision has been taken for investigation/hearing and complaint/letter has been received against the governmental department/officer completely under full control of the government, then regarding that complaint letter will be sent to Principal Secretary/Secretary of concerned department of concerned officer/authorities & government and should be expected in specified validity in 04 copies through government. In this regard the notice will be sent on the form as the Commission may specify. After receiving the report and even after giving the opportunity, if the report is not received, hearing date will be specified, whose written information will be forwarded to complainant on such format, which has been decided by commission. First date of hearing will be decided by the chairman.
On complaints received against autonomous institutions, the concerned officer/ authority/head of the departments will be expected to provide the copy of the complaint letter in the prescribed period in 4 copies. In this regard the notice will be sent on the form as the Commission may specify. After receiving the report and even after giving the opportunity, if the report is not received, hearing date will be specified, whose written information will be forwarded to complainant on such format, which has been decided by commission. First date of hearing will be decided by the chairman.
In the matters in which immediate proceedings are necessary, in those reports and for hearing notice will be forwarded after the approval of chairman.
- (C) Investigation/hearing will be done by committee/bench of commission. As per the need, any information/data required with immediate effect for this investigation, a responsible officer/employee will be sent from commission, who will collect necessary information/data as per the need and will present it in front of concerned committee/bench.
- (D) In the hearing of this type of special investigation by the concerned bench/committee, all logic procedures will be adopted in a consistent manner. In this after inviting complainant and opposition party and their opinion will be heard, opportunity to be given for discussion over the issues pointed out by the parties and the adoption of all the rules of other natural justice is involved.
- (E) The Commission's recommendation on the complaint will be forwarded to the Principal Secretary/Secretary of the concerned department of the government for necessary action.
- (F) The copy of the commission's recommendation on complaints related to autonomous organizations will be transmitted to the head of the autonomous institution (HOD).
Detail of received complaints in Complaint Cell
Complaints about the following topics related to harassment in the Complaint Cell are received:
- Complaint regarding reservation in job.
- Regarding reservation in educational institutions (job/admission).
- Complaints related from reservation in government residents.
- Complaints regarding reservation at hostels.
- Complaint regarding reservation in allotment of plots/house of Housing Schemes (Development Authority/Awas Vikas Parishad).
- Under specific complaints, possession related and police harassment related complaints.
Besides above, wherever provision of reservation is made by state government, proceedings are done as per the specified procedure.
