In the Indian Constitution special facilities and provision for reservation has been made for backward class, so that overall development of this class could be done and backward class can level themselves with other class. In reference to this, V.P. Mandal Commission has been formed by Government of India, with recommendations of whom, concerning to “Indira Sahani vs Bharitya Sangh” case, the nine-member special constitutional bench of Hon’ble High Court released his historical order in 1992 that, to include/expel castes in Other Backward Class every State and Central Government will form tribunal or commission and such tribunal and commission will give their recommendations to the government & government will normally be bound to accept them.
Therefore, in order to give permission for inclusion in the list of backward classes for the permissible reservation in state and for giving proper consideration to the related complaints, Hon’ble Governor of Uttar Pradesh gave permission to form/establish a permanent commission through government order number 22/16/92 karmik-2 dated 09 March 1993.This was named as ‘Uttar Pradesh State Commission for Backward Classes ’ Commission came into existence after Hon’ble President and Hon’ble members took the charge of their duties.
